az Európai Nukleáris Kutatási Szervezet kiváltságairól és mentességeiről szóló Jegyzőkönyv kihirdetéséről[1]

1. § Az Országgyűlés e törvénnyel felhatalmazást ad az Európai Nukleáris Kutatási Szervezet kiváltságairól és mentességeiről szóló Jegyzőkönyv (a továbbiakban: Egyezmény) kötelező hatályának elismerésére.

2. § Az Országgyűlés az Egyezményt e törvénnyel kihirdeti.

3. § Az Egyezmény hiteles szövege és annak hivatalos magyar nyelvű fordítása a következő:

"Protocol on the privileges and immunities of the European Organization for Nuclear Research

Preamble

The States parties to this Protocol,

considering the Convention for the Establishment of a European Organization for Nuclear Research (CERN) and the Financial Protocol annexed thereto, signed on 1st July 1953, entered into force on 29 September 1954 and amended on 17 January 1971,

considering that the Organization has its seat in Geneva, Switzerland, and that its status in Switzerland is defined by the Agreement between the Swiss Federal Council and the Organization dated 11 June 1955,

considering that the Organization is also established in France, where its status is defined by the Agreement between the Government of the French Republic and the Organization dated 13 September 1965, as revised on 16 June 1972,

considering also the Convention between the Federal Council of the Swiss Confederation and the Government of the French Republic dated 13 September 1965 concerning the extension of the Organization's site to include French territory,

considering that the Organization's activities are increasingly extending into the territory of all the States parties to the Convention, with a consequent substantial increase in the mobility of persons and goods assigned to and used for its research programmes,

desiring to ensure the efficient performance of the Organization's functions assigned to it by the Convention, in particular Article II defining the Organization's purposes, and to guarantee it equal treatment on the territory of all the States parties to the Convention,

having resolved to this end, in accordance with Article IX of the Convention, to grant to the Organization the privileges and immunities necessary for the exercise of its official activities,

have agreed as follows:

Article 1

Definitions

For the purpose of this Protocol:

a) the "Convention" refers to the Convention for the Establishment of a European Organization for Nuclear Research and the Financial Protocol annexed thereto, signed on 1st July 1953, entered into force on 29 September 1954 and amended on 17 January 1971;

b) the "Organization" refers to the European Organization for Nuclear Research;

c) "official activities" refers to the activities of the Organization set out in the Convention, in particular its Article II, including its activities of an administrative nature;

d) "officials" refers to the "members of personnel" as defined in the Staff Rules and Regulations of the Organization;

e) "Co-operation Agreement" refers to a bilateral agreement, concluded between the Organization and a non-Member State or a scientific institute established in that State, defining the conditions governing its participation in the activities of the Organization;

f) "Association Agreement" refers to a bilateral agreement, concluded between the Organization and a State ineligible to become a Member State, establishing a close institutional partnership between that State and the Organization in order to allow it to be engaged more deeply in the activities of the Organization.

Article 2

International legal personality

1. The Organization shall have international legal personality and legal capacity on the respective territories of the States parties to this Protocol.

2. The Organization shall in particular have the capacity to contract, to acquire and to dispose of movable and immovable property and to participate in legal proceedings.

Article 3

Inviolability of grounds, buildings and premises

1. The grounds, buildings and premises of the Organization shall be inviolable.

2. No agent of the public authorities may enter them without the express consent of the Director-General or his duly authorised representative.

3. In case of fire or other disaster requiring prompt protective action, where the seeking of such express consent is not practicable, the authorization of the Director-General may be considered as granted.

4. The Organization shall not allow its buildings or premises to serve as a refuge to a person wanted for committing, attempting to commit or just having committed a crime or offence or for whom a warrant of arrest or deportation order has been issued or who has been convicted of a crime or offence by the competent authorities.

Article 4

Inviolability of archives and documents

The archives of the Organization and all documents in whatever form held by the Organization or belonging to it, wherever located and by whomsoever held, shall be inviolable.

Article 5

Immunity from legal process and from execution

1. In the exercise of its official activities, the Organization shall enjoy immunity from legal process, except:

a) in so far as such immunity is waived in a particular case by the Council of the Organization;

b) in respect of a claim by a third party for damage arising from an accident caused by a motor vehicle belonging to, or operated on behalf of, the Organization, or in respect of a motor traffic offence involving such a vehicle;

c) in respect of the enforcement of an arbitration award made under Article 16 or 18 of this Protocol;

d) in respect of a counter-claim relating directly to and introduced in the procedural framework of a claim brought by the Organization.

2. The Organization's property and assets, wherever located, shall enjoy immunity from every form of requisition, confiscation, expropriation, sequestration and any other form of seizure or interference whether by executive, administrative, judicial or legislative action, except:

a) in so far as such immunity is waived in a particular case by the Council of the Organization;

b) in so far as may be temporarily necessary in connection with the prevention or investigation of accidents involving motor vehicles belonging to, or operated on behalf of, the Organization;

c) in the event of an attachment of salary, enforced for a debt of an official of the Organization, provided that such attachment results from a final and enforceable decision in accordance with the rules and regulations in force on the territory of enforcement.

Article 6

Fiscal and customs arrangements

1. Within the scope of its official activities, the Organization, its property and income shall be exempt from direct taxes.

2. When, in the exercise of its official activities, the Organization makes purchases of, or uses, goods or services of substantial value, in the price of which taxes, duties or other charges are included, appropriate measures shall be taken by the State party to this Protocol which has levied the taxes, duties or other charges to remit or reimburse the amount of such taxes, duties or other charges where they are identifiable.

3. The importation and exportation by or on behalf of the Organization of goods and materials in the exercise of its official activities shall be exempt from all import and export taxes, duties and other charges.

4. No exemption or reimbursement shall be granted for duties, taxes or other charges of any kind which only constitute remuneration for services rendered.

5. The provisions of paragraphs 2 and 3 of this Article are not applicable to the purchase or use of goods or services or the import of goods intended for the personal use of the officials and of the Director-General of the Organization.

6. Goods and materials belonging to the Organization which have been acquired or imported in accordance with the provisions of paragraph 2 or 3 of this Article shall not be sold or donated on the territory of the State which has granted the exemption except under the conditions laid down by that State.

Article 7

Free disposal of funds

The Organization may freely receive, hold and transfer any kind of funds, currency and cash; it may dispose of them freely for its official activities and hold accounts in any currency to the extent required to meet its obligations.

Article 8

Official communications

The circulation of publications and other information material, received or sent by the Organization in whatever form in the exercise of its official activities, shall not be restricted in any way.

Article 9

Privileges and immunities of the States representatives

1. The representatives of the States parties to this Protocol shall enjoy, in the exercise of their functions and in the course of journeys to and from the place of meetings of the Organization, the following privileges and immunities:

a) immunity from personal arrest, detention and seizure of their personal effects;

b) immunity from legal process, even after the termination of their mission, in respect of acts, including words spoken or written, done by them in the exercise of their functions; this immunity shall not apply, however, in the case of a motor vehicle offence committed by a representative of a State party, nor in the case of damage caused by a motor vehicle belonging to or driven by her or him;

c) inviolability of all official documents in whatever form held;

d) the right to use codes and to receive documents and correspondence by courier or sealed luggage;

e) for them and their spouses, exemption from all measures restricting entry and aliens' registration formalities;

f) the same facilities concerning currency and exchange regulations as those granted to the representatives of foreign Governments on temporary official missions;

g) the same customs facilities as regards their personal luggage as those granted to diplomatic agents.

2. No State party to this Protocol shall be obliged to accord the privileges and immunities set out in this Article to its own nationals or to persons who, at the moment of taking up their duties in that State party, are permanent residents thereof.

Article 10

Privileges and immunities of the officials of the Organization

1. The officials of the Organization shall enjoy immunity, even after the termination of their functions, from legal process in respect of acts, including words spoken or written done by them in the exercise of their functions and within the limits of their duties. This immunity shall not apply, however, in the case of a motor vehicle offence committed by an official of the Organization nor in the case of damage caused by a motor vehicle belonging to or driven by her or him.

2. The officials of the Organization shall enjoy the following privileges:

a) the right to import free of duty their furniture and personal effects at the time of taking up their appointment with the Organization in the State concerned and the right, on the termination of their functions in that State, to export free of duty their furniture and personal effects, subject, in both cases, to the conditions imposed by the laws and regulations of the State where the right is exercised;

b)

(i) subject to the conditions and following the procedures laid down by the Council of the Organization, the officials and the Director-General of the Organization shall be subject to a tax, for the benefit of the Organization, on salaries and emoluments paid by the Organization. Such salaries and emoluments shall be exempt from national income tax,

(ii) the States Parties to this Protocol shall not be obliged to exempt from income tax pensions or annuities paid by the Organization to its former officials and Directors-General in respect of their service with the Organization;

c) for themselves and the family members forming part of their household, the same exemption from immigration restrictions and aliens' registration formalities as are normally granted to officials of international organizations;

d) inviolability of all official documents, in whatever form held;

e) for themselves and the family members forming part of their household, the same repatriation facilities in time of international crisis as the members of diplomatic missions;

f) in respect of transfers of funds and currency exchange and customs facilities, the privileges generally granted to the officials of international organizations.

3. No State party to this Protocol shall be obliged to accord the privileges and immunities referred to in paragraphs 2 a), c), e) and f) of this Article to its own nationals or to persons who, at the moment of taking up their duties in that State party, are permanent residents thereof.

Article 11

Social security

The Organization and the officials employed by the Organization shall be exempt from all compulsory contributions to national social security schemes, on the understanding that such persons are provided with equivalent social protection coverage by the Organization.

Article 12

Privileges and immunities of the Director-General

1. In addition to the privileges and immunities provided for in Articles 10 and 11 of this Protocol, the Director-General shall enjoy throughout the duration of her or his functions the privileges and immunities granted by the Vienna Convention on Diplomatic Relations of 18 April 1961 to diplomatic agents of comparable rank.

2. No State party to this Protocol shall be obliged to accord the privileges and immunities referred to in this Article to its own nationals or to persons who, at the moment of taking up their duties in that State party, are permanent residents thereof.

Article 13

Object and limits of the immunities

1. The privileges and immunities provided for in Articles 9, 10 and 12 of this Protocol are granted solely to ensure the unimpeded functioning of the Organization and the complete independence of the persons to whom they are accorded. They are not granted for the personal benefit of the individuals concerned.

2. Such immunities may be waived:

a) in the case of the Director-General, by the Council of the Organization,

b) in the case of officials, by the Director-General or the person acting in his stead as provided in Article VI, paragraph 1 b), of the Convention,

c) in the case of State representatives, by the State party concerned,

and there is a duty to do so in any particular case where they would impede the course of justice and can be waived without prejudice to the purpose for which they are accorded.

Article 14

Co-operation with the States parties to this Protocol

The Organization shall co-operate with the competent authorities of the States parties to this Protocol in order to facilitate the proper administration of justice, the observance of laws and regulations on police, public health, health and safety at work and on the environment, and to prevent any abuse of privileges, immunities and facilities provided for in this Protocol.

Article 15

Security and public order

1. The right of a State party to this Protocol to take precautionary measures in the interest of its security shall not be prejudiced by any provision in this Protocol.

2. If a State party to this Protocol considers it necessary to take measures for its security or for the maintenance of public order, it shall, except where this is not practicable, approach the Organization as rapidly as circumstances allow in order to determine, by mutual agreement, the measures necessary to protect the interests of the Organization.

3. The Organization shall co-operate with the Government of such State party to this Protocol to avoid any prejudice to the security or public order of such State party to this Protocol resulting from its activities.

Article 16

Disputes of a private nature

1. The Organization shall make provision for appropriate modes of settlement of:

a) disputes arising from contracts to which the Organization is a party;

the Organization shall include, in all written contracts into which it enters, other than those referred to in paragraph 1 d) of this Article, an arbitration clause under which any disputes arising out of the interpretation or execution of the contract shall, at the request of either party, be submitted to arbitration or, if so agreed by the parties, to another appropriate mode of settlement;

b) disputes arising out of damages caused by the Organization or involving any other non-contractual liability of the Organization;

c) disputes involving an official of the Organization who enjoys immunity from legal process, if such immunity has not been waived in accordance with the provisions of Article 5 of this Protocol;

d) disputes arising between the Organization and its officials;

the Organization shall submit all disputes arising from the application and interpretation of contracts concluded with officials of the Organization on the basis of the Staff Rules and Regulations of the Organization to the jurisdiction of the International Labour Organization Administrative Tribunal (ILOAT) or to any other appropriate international administrative tribunal to the jurisdiction of which the Organization is submitted following a decision by the Council.

2. For disputes for which no particular mode of settlement is specified in paragraph 1 of this Article, the Organization may resort to any mode of settlement it deems appropriate, in particular to arbitration or to referral to a national tribunal.

3. Any mode of settlement selected under this Article shall be based on the principles of due process of law, with a view to the timely, fair, impartial and binding settlement of the dispute.

Article 17

Disputes between States parties to this Protocol

1. Any difference of opinion concerning the application or interpretation of this Protocol which is not settled amicably between the parties may be submitted by either party to an international Arbitration Tribunal, in accordance with Article 19 of this Protocol.

2. If a State party to this Protocol intends to submit a dispute to arbitration, it shall notify the Director-General, who shall immediately inform each State party to this Protocol of such notification.

Article 18

Disputes between States parties to this Protocol and the Organization

1. Any difference of opinion between one or more States parties to this Protocol and the Organization concerning the application or interpretation of this Protocol which is not settled amicably between the parties [one or more State(s) party(ies) to this Protocol constituting one party to the dispute and the Organization constituting the other party] may be submitted by either party to an international Arbitration Tribunal, in accordance with Article 19 of this Protocol.

2. The Director-General shall immediately inform the other States parties to this Protocol of the notification given by the Party applying for arbitration.

Article 19

International Arbitration Tribunal

1. The international Arbitration Tribunal referred to in Articles 17 and 18 of this Protocol ("the Tribunal") shall be governed by the provisions of this Article.

2. Each party to the dispute shall appoint one member of the Tribunal. The members thus appointed shall jointly choose a third member, who shall be the Chairman of the Tribunal. In the event of disagreement between the members of the Tribunal on the choice of Chairman, the latter shall be appointed by the President of the International Court of Justice at the request of the members of the Tribunal.

3. If one of the parties to the dispute fails to appoint a member of the Tribunal and has not taken steps to do so within two months following a request by the other party, the other party may request the President of the International Court of Justice to make the appointment.

4. The Tribunal shall determine its own procedure.

5. There shall be no right of appeal against the award of the Tribunal, which shall be final and binding on the parties. In the event of a dispute concerning the import or scope of the award, it shall be incumbent upon the Tribunal to give an interpretation at the request of either party.

Article 20

Implementation of the Protocol

The Organization may, if the Council of the Organization so decides, conclude additional Agreements with one or more States parties to this Protocol in order to implement the provisions of this Protocol.

Article 21

Amendment Procedure

1. Amendments to this Protocol may be proposed by any State party to the Convention and shall be communicated by the Director-General of the Organization to the other States parties to this Protocol.

2. The Director-General shall convene a meeting of the States parties to this Protocol. If the meeting adopts, by a two-thirds majority of the States parties present and voting, the proposed text of the amendment, it shall be forwarded by the Director-General to States parties to this Protocol for acceptance in accordance with their respective constitutional requirements.

3. Any such amendment shall come into force on the thirtieth day after all States parties to this Protocol have notified the Director-General of their ratification, acceptance or approval thereof.

Article 22

Particular Agreements

1. The provisions of this Protocol shall not limit or prejudice the provisions of other international agreements concluded between the Organization and a State Party to this Protocol by reason of the location in the territory of that State party of its headquarters, regional offices, laboratories or other installations. In case of conflict between the provisions of this Protocol and those of such an international agreement, the provisions of that international agreement shall prevail.

2. Nothing in this Protocol shall preclude States parties to this Protocol from concluding other international agreements with the Organization confirming, supplementing, extending or amplifying the provisions of this Protocol.

Article 23

Signature, ratification and accession

1. This Protocol shall be open for signature from 19 December 2003 until 19 December 2004 by the States parties to the Convention and by the States which have concluded a Co-operation or an Association Agreement with the Organization.

2. This Protocol shall be subject to ratification, acceptance or approval by signatory States. The instruments of ratification, acceptance or approval shall be deposited with the Director-General of the United Nations Educational, Scientific and Cultural Organization (UNESCO) .

3. This Protocol shall remain open for accession by the States parties to the Convention and by the States which have concluded a Co-operation or an Association Agreement with the Organization. The instruments of accession shall be deposited with the Director-General of UNESCO.

Article 24

Entry into force

1. This Protocol shall enter into force thirty days after the date on which the twelfth instrument of ratification, acceptance, approval or accession by a State party to the Convention is deposited.

2. For each State ratifying, accepting, approving or acceding to this Protocol after its entry into force, this Protocol shall enter into force on the thirtieth day following the deposit with the Director-General of UNESCO of its instrument of ratification, acceptance, approval or accession.

Article 25

Notification

The Director-General of UNESCO shall notify all signatory and acceding States of this Protocol and the Director-General of the Organization of the deposit of each instrument of ratification, acceptance, approval or accession, of the entry into force of this Protocol, as well as of any notification of its denunciation.

Article 26

Registration

The Director-General of the United Nations Educational, Scientific and Cultural Organization (UNESCO) shall, upon the entry into force of this Protocol, register it with the Secretariat of the United Nations in accordance with Article 102 of the Charter of the United Nations.

Article 27

Denunciation

Any State party to this Protocol may, at any time, by written notification addressed to the Director-General of UNESCO, denounce this Protocol. The denunciation shall take effect on the date one year after the date of receipt of such notification, unless the notification specifies a later date.

In witness whereof, the undersigned representatives, having been duly authorized thereto by their respective Governments, have signed this Protocol.

Done at Geneva, on ..., in the English and French languages, both texts being equally authoritative and deposited in the archives of the United Nations Educational, Scientific and Cultural Organization (UNESCO), the Director-General of which shall transmit a certified copy to all signatory and acceding States."

Preambulum

A jegyzőkönyv részes államai,

figyelemmel az Európai Nukleáris Kutatási Szervezet (CERN) létrehozásáról szóló, 1953. július 1-jén aláírt, 1954. szeptember 29-én hatályba lépett és 1971. január 17-én módosított egyezményre és az ahhoz csatolt pénzügyi jegyzőkönyvre,

figyelemmel arra, hogy a szervezet székhelye a svájci Genfben van, és svájci státuszát az 1955. június 11-én a Svájci Szövetségi Tanács és a szervezet között létrejött megállapodás határozza meg,

figyelemmel arra, hogy a szervezetnek Franciaországban is van székhelye, ahol státuszát a Francia Köztársaság Kormánya és a szervezet között 1965. szeptember 13-án létrejött megállapodás határozza meg,

figyelemmel a Svájci Szövetségi Tanács és a Francia Köztársaság Kormánya között 1965. szeptember 13-án létrejött, a szervezet területének francia területtel való kibővítéséről szóló megállapodásra is,

figyelemmel arra, hogy a szervezet tevékenysége egyre inkább kiterjed az egyezményben részes valamennyi állam területére, ami együtt jár a CERN kutatási programjaiban részt vevő személyek, illetve a kutatási programoknak juttatott és az azokban felhasznált áruk mobilitásának lényeges fokozódásával,

azzal az óhajjal, hogy biztosítsák a szervezet létrehozásáról szóló egyezményben és különösen annak a szervezet céljait meghatározó II. cikkében a szervezet számára előírt feladatok hatékony teljesítését, és hogy a szervezetnek azonos bánásmódot garantáljanak az egyezményben részes valamennyi állam területén,

azzal az elhatározással, hogy e célból az egyezmény IX. cikkével összhangban megadják a szervezetnek a hivatalos működéséhez szükséges kiváltságokat és mentességeket,

a következőkben állapodtak meg:

1. cikk

Fogalommeghatározások

E jegyzőkönyv alkalmazásában:

a) "egyezmény": az Európai Nukleáris Kutatási Szervezet (CERN) létrehozásáról szóló, 1953. július 1-jén aláírt, 1954. szeptember 29-én hatályba lépett és 1971. január 17-én módosított egyezmény és a hozzá csatolt pénzügyi jegyzőkönyv;

b) "szervezet": az Európai Nukleáris Kutatási Szervezet;

c) "hivatalos tevékenység": a szervezetnek az egyezményben, különösen annak II. cikkében megjelölt tevékenységei, beleértve a szervezet adminisztratív jellegű tevékenységét is;

d) "tisztviselők": a "személyzet tagjai", a szervezet személyzeti szabályzatában meghatározottak szerint;

e) "együttműködési megállapodás": a szervezet és egy nem tagország vagy egy nem tagországban alapított tudományos intézet közötti kétoldalú megállapodás, amely meghatározza a szervezet tevékenységeiben való részvétel feltételeit;

f) "társulási megállapodás": a szervezet és egy, a tagság feltételeinek eleget nem tevő állam közötti kétoldalú megállapodás, amely szoros intézményi partnerséget hoz létre az illető állam és a szervezet között annak érdekében, hogy az adott állam fokozottabban részt vehessen a szervezet tevékenységében.

2. cikk

Nemzetközi jogi személyiség

1. A jegyzőkönyvet aláíró államok saját területükön elismerik a szervezet nemzetközi jogi személyiségét és jogképességét.

2. A szervezet jogképessége kiterjed különösen a szerződéskötésre, az ingó és ingatlan vagyon szerzésére és elidegenítésére, továbbá a bíróság előtti eljárásra.

3. cikk

A telephelyek, épületek és helyiségek sérthetetlensége

1. A szervezet telephelyei, épületei és helyiségei sérthetetlenek.

2. A hatóságok egyetlen képviselője sem léphet be az említett területekre a főigazgató vagy megfelelően meghatalmazott képviselője kifejezett hozzájárulása nélkül.

3. Azonnali védőintézkedést kívánó tűzeset vagy egyéb katasztrófa esetén, amikor ilyen hozzájárulás igénylésére nincs mód, a főigazgató hozzájárulása megadottnak tekinthető.

4. A szervezet nem engedheti meg, hogy épületei vagy létesítményei menedékül szolgáljanak olyan személy számára, akit bűncselekmény elkövetése vagy kísérlete miatt köröznek, vagy akit bűncselekmény elkövetésén tetten értek, továbbá akivel szemben letartóztatási parancsot vagy kiutasítási határozatot hoztak, illetve akit az illetékes hatóságok bűncselekmény elkövetése miatt elítéltek.

4. cikk

Az irattár és a dokumentumok sérthetetlensége

A szervezet irattára és a szervezethez tartozó vagy az általa tárolt bármilyen formátumú valamennyi dokumentum, tekintet nélkül a tárolás helyére és a tárolással megbízott személyre, sérthetetlen.

5. cikk

Mentesség a bírósági eljárás és végrehajtás alól

1. Hivatalos tevékenységei gyakorlása során a szervezetet mentesség illeti meg a bírósági eljárások alól, kivéve

a) ha a mentességet a szervezet tanácsa egy meghatározott ügyben felfüggeszti;

b) a szervezethez tartozó vagy a szervezet nevében működtetett gépjármű által okozott baleset miatt keletkezett kár tekintetében harmadik fél által benyújtott kártérítési igény, vagy egy ilyen járművel okozott közlekedési szabálysértés vonatkozásában;

c) az e jegyzőkönyv 16. vagy 18. cikke alapján hozott választottbírósági döntés végrehajtása vonatkozásában;

d) a szervezet által benyújtott kereset tekintetében és annak eljárási keretében benyújtott viszontkereset vonatkozásában.

2. A szervezet tulajdonát és vagyonát, bárhol található is, mentesség illeti meg az igénybevétel, elkobzás, kisajátítás vagy zár alá vétel bármely formája, illetve a lefoglalás és beavatkozás bármely más módja alól végrehajtási, közigazgatási, bírósági vagy törvényhozási intézkedés során, kivéve

a) ha a mentességet a szervezet tanácsa egy meghatározott ügyben felfüggeszti;

b) ha erre ideiglenesen szükség van a szervezethez tartozó vagy a szervezet nevében működtetett gépjárművek által okozott balesetek megelőzésével vagy kivizsgálásával kapcsolatban;

c) fizetésletiltás esetén a szervezet egy tisztviselője adósságának végrehajtásakor, amennyiben a letiltás egy, az érvényben lévő végrehajtási előírásoknak és szabályozásnak megfelelő végleges és végrehajtható döntés eredménye.

6. cikk

Adó- és vámrendelkezések

1. Hivatalos tevékenységi körén belül a szervezet, annak tulajdona és jövedelme mentes minden közvetlen adó alól.

2. Amennyiben a szervezet hivatalos tevékenysége gyakorlása során olyan jelentős értékű árut, illetve szolgáltatást vásárol vagy vesz igénybe, amelynek ára adót, vámot vagy egyéb terhet tartalmaz, az adót, vámot vagy egyéb terhet kivető részes államok megteszik a megfelelő intézkedéseket azok visszautalására vagy visszatérítésére, amennyiben összegük megállapítható.

3. A szervezet által vagy a szervezet nevében hivatalos tevékenysége gyakorlása során behozott vagy kivitt áruk és anyagok mentesek mindenfajta import- és exportadók, vámok vagy egyéb terhek alól.

4. Nem jár mentesség vagy visszatérítés a szolgáltatások nyújtásának díjába foglalt vámok, adók vagy egyéb terhek tekintetében.

5. E cikk 2. és 3. bekezdésének rendelkezései nem alkalmazhatók a szervezet tisztviselőinek és a főigazgatónak a személyes használatára szolgáló áruk vásárlása vagy az ilyen szolgáltatások igénybevétele, illetve áruk behozatala esetén.

6. A szervezethez tartozó, e cikk 2. és 3. bekezdése rendelkezéseinek megfelelően szerzett vagy behozott árukat és anyagokat csak az illető állam által meghatározott feltételek szerint lehet eladni vagy elajándékozni annak az államnak a területén, amely a mentesítést adta.

7. cikk

Pénzeszközökkel való szabad rendelkezés

A szervezet szabadon fogadhat, tarthat és utalhat át mindennemű pénzeszközt, valutát és készpénzt; szabadon rendelkezhet azokról hivatalos tevékenysége érdekében, és számlákat tarthat fent bármely valutában a kötelezettségei teljesítéséhez szükséges mértékben.

8. cikk

Hivatalos tájékoztatás

A szervezet hivatalos tevékenysége során fogadott vagy küldött bármely formájú kiadványának és egyéb információs anyagainak terjesztése semmiféle módon nem korlátozható.

9. cikk

Az államok képviselőinek kiváltságai és mentességei

1. E jegyzőkönyv részes államainak képviselőit feladataik gyakorlása, illetve a szervezet üléseinek helyszínére történő utazásuk és onnan való visszatérésük során az alábbi kiváltságok és mentességek illetik meg:

a) mentesség a személyes őrizetbe vétel, fogva tartás és személyes használati tárgyaik lefoglalása alól;

b) mentesség a bírósági eljárások alól - még kiküldetésük befejezése után is - feladataik gyakorlása során végzett cselekedeteik, szóbeli vagy írásbeli megnyilatkozásaik tekintetében; ez a mentesség nem alkalmazandó egy részes állam képviselője által gépjárművel elkövetett szabálysértés esetén, sem olyan kár esetén, amelyet a fentebb említett személy tulajdonába tartozó vagy általa vezetett gépjárművel okoztak;

c) valamennyi hivatalos dokumentum sérthetetlensége, formátumtól függetlenül;

d) a kódhasználat és a futár igénybevételével vagy lepecsételt küldeménnyel történő levelezés joga;

e) számukra és házastársaik számára mentesítés minden belépési korlátozás és külföldiek nyilvántartásba vételével kapcsolatos alakiság alól;

f) a valuta- és devizaszabályokkal kapcsolatban ugyanazok a könnyítések, mint amelyeket a külföldi kormányok képviselői élveznek ideiglenes hivatalos kiküldetéseik során;

g) személyi poggyászukkal kapcsolatban ugyanazok a vámkönnyítések, mint amelyeket a diplomáciai képviselők élveznek.

2. E jegyzőkönyv egyetlen részes állama sem köteles az e cikkben megállapított kiváltságokat és mentességeket megadni saját állampolgárainak, illetve azoknak a személyeknek, akik a részes állambeli szolgálatuk megkezdése időpontjában ugyanott állandó lakosok voltak.

10.cikk

A szervezet tisztviselőinek kiváltságai és mentességei

1. A szervezet tisztviselői mentességet élveznek - még hivatalos tevékenységük befejezése után is - feladataik gyakorlása során és azok keretein belül végzett cselekedeteik, szóbeli vagy írásbeli megnyilatkozásaik tekintetében. Ez a mentesség nem alkalmazandó egy részes állam képviselője által gépjárművel elkövetett szabálysértés esetén, sem olyan kár esetén, amelyet a fentebb említett személy tulajdonába tartozó vagy általa vezetett gépjárművel okoztak.

2. A szervezet tisztviselőit az alábbi kiváltságok illetik meg:

a) a szervezetnél folytatott tevékenységük megkezdésekor vámmentesen vihetik be bútoraikat és személyes holmijukat az érintett államba, valamint feladataik megszűnésekor onnan vámmentesen kivihetik azokat, mindkét esetben az érintett állam törvényei és rendeletei által meghatározott feltételekre is figyelemmel;

b)

(i) a szervezet tanácsa által meghatározott feltételeknek és eljárásnak megfelelően a szervezet tisztviselői és főigazgatója a szervezettől kapott fizetésük és jövedelmük után a szervezet számára kötelező befizetéseket teljesítenek. Ezek a fizetések és jövedelmek mentesek a nemzeti jövedelemadó alól,

(ii) e jegyzőkönyv részes államai nem kötelesek a szervezet korábbi tisztviselőinek és főigazgatóinak a szervezetnél folytatott tevékenységük vonatkozásában kapott nyugdíját vagy a szervezet által folyósított járadékait mentesíteni a jövedelemadó alól;

c) saját maguk és velük egy háztartásban élő családtagjaik számára ugyanazok a mentességek érvényesek a belépési korlátozások és külföldiek nyilvántartásba vételével kapcsolatos alakiságok tekintetében, mint amelyeket általában a nemzetközi szervezetek tisztviselői megkapnak;

d) valamennyi hivatalos dokumentum sérthetetlensége, formátumtól függetlenül;

e) nemzetközi krízis esetén saját maguk és velük egy háztartásban élő családtagjaik számára ugyanazok a hazatérési könnyítések érvényesek, mint a diplomáciai képviseletek tagjai számára;

f) a nemzetközi szervezetek tisztviselői számára általában biztosított kiváltságok pénzeszközök átutalása, valutaátváltás és vámkönnyítések tekintetében.

3. E jegyzőkönyv egyetlen részes állama sem köteles az e cikk 2. bekezdésének a), c), e) és f) pontjában megállapított kiváltságokat és mentességeket megadni saját állampolgárainak, illetve azoknak a személyeknek, akik a részes állambeli szolgálatuk megkezdése időpontjában ugyanott állandó lakosok voltak.

11.cikk

Társadalombiztosítás

A szervezet és tisztviselői mentesek a nemzeti társadalombiztosítási rendszerekhez való bármely kötelező hozzájárulás alól, azzal a feltétellel, hogy ezeket a személyeket a szervezet azonos mértékű szociális védelemben részesíti.

12.cikk

A főigazgató kiváltságai és mentességei

1. Az e jegyzőkönyv 10. és 11. cikkeiben nyújtott kiváltságokon és mentességeken kívül a főigazgatót megbízatásának ideje alatt megilletik a diplomáciai kapcsolatokról szóló 1961. április 18-i bécsi szerződés által a megfelelő rangú diplomáciai képviselőknek nyújtott kiváltságok és mentességek is.

2. E jegyzőkönyv egyetlen részes állama sem köteles az e cikkben megállapított kiváltságokat és mentességeket megadni saját állampolgárainak, illetve azoknak a személyeknek, akik a részes állambeli szolgálatuk megkezdése időpontjában ugyanott állandó lakosok voltak.

13.cikk

A mentességek tárgya és korlátai

1. Az e jegyzőkönyv 9., 10. és 12. cikkében megadott kiváltságok és mentességek kizárólag a szervezet akadálytalan működésének és a kedvezményezett személyek teljes függetlenségének biztosítására és nem az érintett személyek személyes javára szolgálnak.

2. A mentességek felfüggeszthetők:

a) a főigazgató esetében a szervezet tanácsa által,

b) a tisztviselők esetében a főigazgató vagy a helyette eljáró személy által, az egyezmény VI. cikke (1) bekezdésének b) pontjában meghatározottak szerint,

c) az államok képviselői esetében az érintett részes állam által,

illetve a mentességeket fel kell függeszteni minden olyan esetben, ahol azok akadályoznák az igazságszolgáltatás menetét, a megállapításukat indokló cél sérelme nélkül.

14.cikk

Együttműködés e jegyzőkönyv részes államaival

A szervezet együttműködik e jegyzőkönyv részes államainak illetékes hatóságaival a megfelelő igazságszolgáltatás, a rendőrségre, a közegészségügyre, a munkahelyi egészségvédelemre és biztonságra és a környezetre vonatkozó törvények és rendeletek tiszteletben tartásának megkönnyítése, valamint az e jegyzőkönyv által nyújtott kiváltságokkal, mentességekkel és könnyítésekkel kapcsolatos visszaélések megakadályozása érdekében.

15.cikk

Biztonság és közrend

1. E jegyzőkönyv egyetlen rendelkezése sem sérti részes államai azon jogát, hogy saját biztonságuk érdekében megelőző intézkedéseket tegyenek.

2. Amennyiben e jegyzőkönyv egy részes állama intézkedések megtételét tartja szükségesnek saját biztonsága vagy a közrend fenntartása érdekében, a körülményekhez képest leggyorsabban érintkezésbe kell lépnie a szervezettel - kivéve, ha ez nem megvalósítható -, hogy kölcsönös megegyezéssel meghatározzák a szervezet érdekeinek védelméhez szükséges intézkedéseket.

3. A szervezet együttműködik e jegyzőkönyv érintett részes államának kormányával annak érdekében, hogy a jegyzőkönyv érintett részes állama biztonságának vagy közrendjének a szervezet tevékenységéből eredő sérelmét elkerüljék.

16.cikk

Magánjogi jogviták

1. A szervezet gondoskodik az alábbi jogviták megfelelő módon történő rendezéséről:

a) a szervezet által kötött szerződésekből származó jogviták;

a szervezetnek az e cikk 1. bekezdésének d) pontjában meghatározottak kivételével minden általa kötött írásbeli szerződésbe bele kell foglalnia egy választottbírósági kikötést, melynek értelmében a szerződés értelmezéséből vagy végrehajtásából eredő jogvitákkal bármely fél kérésére a választottbírósághoz kell fordulni, vagy, ha a felek úgy egyeznek meg, más módon kell azokat rendezni;

b) a szervezet által okozott károkból származó, vagy egyéb, a szervezet szerződésen kívüli felelősségével kapcsolatos jogviták;

c) olyan jogviták, amelyekben érintett a szervezet egy bírósági eljárások alól mentességet élvező tisztviselője is, amennyiben e mentessége nem került felfüggesztésre e jegyzőkönyv 5. cikke rendelkezéseinek értelmében;

d) a szervezet és tisztviselői közötti jogviták;

a szervezet minden olyan jogvitát, amely a szervezet tisztviselőivel a szervezet személyzeti szabályzata alapján kötött szerződések alkalmazása és értelmezése kapcsán keletkezett, a Nemzetközi Munkaügyi Szervezet Közigazgatási Bírósága (ILOAT) vagy bármely olyan megfelelő nemzetközi közigazgatási bíróság elé terjeszt, mely joghatóságának a szervezet a tanács döntése alapján aláveti magát.

2. Az olyan jogviták esetében, melyek rendezési módját e cikk 1. bekezdése nem határozza meg, a szervezet bármely általa megfelelőnek tartott rendezési módhoz, nevezetesen választottbírósághoz vagy nemzeti bírósághoz fordulhat.

3. Az e cikk alapján választott bármely rendezési módnak megfelelő törvényi eljáráson kell alapulnia, a jogvita időben történő, tisztességes, pártatlan és kötelező rendezését szem előtt tartva.

17.cikk

A jegyzőkönyv részes államai közötti jogviták

1. Az e jegyzőkönyv alkalmazásával és értelmezésével kapcsolatos, a felek között békés úton nem rendezett véleménykülönbség ügyében bármely fél nemzetközi választottbírósághoz fordulhat, e jegyzőkönyv 19. cikkének megfelelően.

2. Amennyiben e jegyzőkönyv egy részes állama választottbírósághoz kíván fordulni egy vitás ügyben, értesítenie kell erről a főigazgatót, aki haladéktalanul tájékoztatja e jegyzőkönyv többi részes államát az értesítésről.

18.cikk

A jegyzőkönyv részes államai és a szervezet közötti jogviták

1. A jegyzőkönyv egy vagy több részes állama és a szervezet közötti, e jegyzőkönyv alkalmazásával vagy értelmezésével kapcsolatos, a felek (egyrészről a jegyzőkönyv egy vagy több részes állama, másrészről a szervezet) között békés úton nem rendezett véleménykülönbség ügyében bármely fél nemzetközi választottbírósághoz fordulhat, e jegyzőkönyv 19. cikkének megfelelően.

2. A főigazgató haladéktalanul tájékoztatja e jegyzőkönyv többi részes államát a választottbírósághoz forduló fél által történt értesítésről.

19.cikk

Nemzetközi választottbíróság

1. Az e jegyzőkönyv 17. és 18. cikkében hivatkozott nemzetközi választottbíróságra e cikk rendelkezései vonatkoznak.

2. A vitában álló két fél egy-egy tagot jelöl a bíróságba. Az így kijelölt tagok közösen választanak egy harmadik tagot, aki a bíróság elnöke lesz. Amennyiben a bíróság tagjai nem tudnak megegyezni az elnök személyében, azt a Nemzetközi Bíróság elnöke jelöli ki a választottbíróság tagjainak felkérésére.

3. Amennyiben az egyik vitában álló fél elmulaszt választottbírósági tagot jelölni, és a másik fél kérését követő két hónapban nem tesz intézkedéseket ennek érdekében, a másik fél felkérheti a Nemzetközi Bíróság elnökét a tagjelölésre.

4. A bíróság elfogadja eljárási szabályzatát.

5. A bíróság döntése ellen fellebbezés nincs, az a felek számára végleges és kötelező érvényű. A döntés értelmezésével vagy hatályával kapcsolatos jogvita esetén a bíróság értelmezést ad bármely fél kérésére.

20.cikk

A jegyzőkönyv végrehajtása

A szervezet tanácsának döntése alapján a szervezet kiegészítő megállapodásokat köthet e jegyzőkönyv egy vagy több részes államával a jegyzőkönyv rendelkezéseinek végrehajtása érdekében.

21.cikk

Módosítási eljárás

1. E jegyzőkönyv módosítására az egyezmény bármely részes állama tehet javaslatot. A módosító javaslatokról a szervezet főigazgatója tájékoztatja a jegyzőkönyv többi részes államát.

2. A főigazgató összehívja a jegyzőkönyv részes államainak közgyűlését. Amennyiben a jelenlévő és szavazó részes államok kétharmados többséggel elfogadják a módosítás javasolt szövegét, a főigazgató továbbítja azt a jegyzőkönyv részes államainak az alkotmányos követelményeikkel összhangban történő elfogadásra.

3. Minden ilyen módosítás harminc nappal azt követően lép hatályba, hogy e jegyzőkönyv valamennyi részes állama értesítette a főigazgatót a megerősítésről, elfogadásról vagy jóváhagyásról.

22.cikk

Különmegállapodások

1. E jegyzőkönyv rendelkezései nem korlátozzák vagy sértik a szervezet és a jegyzőkönyv egy részes állama között a szervezet központjának, területi irodáinak, laboratóriumainak vagy más berendezéseinek az illető részes állam területén való elhelyezkedésére vonatkozóan kötött egyéb nemzetközi egyezmények rendelkezéseit.

2. E jegyzőkönyv tartalma nem zárja ki, hogy részes államai a szervezettel más olyan nemzetközi szerződéseket kössenek, amelyek megerősítik, kiegészítik, kiterjesztik vagy kibővítik e jegyzőkönyv rendelkezéseit.

23.cikk

Aláírás, megerősítés és csatlakozás

1. E jegyzőkönyv 2003. december 19-től 2004. december 19-ig áll nyitva aláírásra az egyezmény részes államai és a szervezettel együttműködési vagy társulási megállapodást kötött államok részére.

2. E jegyzőkönyvet az aláíró államok megerősítik, elfogadják vagy jóváhagyják. A megerősítő, elfogadó vagy jóváhagyó okiratokat az Egyesült Nemzetek Oktatási, Tudományos és Kulturális Szervezete (UNESCO) főigazgatójánál helyezik letétbe.

3. E jegyzőkönyv nyitva marad a csatlakozásra az egyezmény részes államai és a szervezettel együttműködési vagy társulási megállapodást kötött államok részére. A csatlakozási okiratokat az UNESCO főigazgatójánál helyezik letétbe.

24.cikk

Hatálybalépés

1. E jegyzőkönyv harminc nappal azt követően lép hatályba, hogy a jegyzőkönyv valamelyik részes állama letétbe helyezi a tizenkettedik megerősítő, elfogadó, jóváhagyó vagy csatlakozási okiratot.

2. Azokban az államokban, amelyek esetében a megerősítés, elfogadás, jóváhagyás vagy csatlakozás a jegyzőkönyv hatálybalépése után történik meg, a jegyzőkönyv harminc nappal azt követően lép hatályba, hogy az illető állam megerősítő, elfogadó, jóváhagyó vagy csatlakozási okiratát az UNESCO főigazgatójánál letétbe helyezik.

25.cikk

Értesítés

Az UNESCO főigazgatója minden megerősítő, elfogadó, jóváhagyó vagy csatlakozási okirat letétbe helyezéséről, e jegyzőkönyv hatálybalépéséről, valamint a felmondásáról szóló valamennyi értesítésről értesíti e jegyzőkönyv valamennyi aláíró és csatlakozó államát és a szervezet főigazgatóját.

26.cikk

Nyilvántartásba vétel

Az Egyesült Nemzetek Oktatási, Tudományos és Kulturális Szervezete (UNESCO) főigazgatója e jegyzőkönyv hatálybalépésekor nyilvántartásba veszi azt az Egyesült Nemzetek Titkárságánál az Egyesült Nemzetek Alapokmánya 102. cikkének megfelelően.

27.cikk

Felmondás

E jegyzőkönyv bármely részes állama az UNESCO főigazgatójának címzett írásos értesítésben bármikor felmondhatja e jegyzőkönyvet. A felmondás az értesítés kézhezvételének időpontjától számított egy év elteltével lép hatályba, kivéve, ha az értesítés későbbi időpontot határoz meg.

A fentiek hiteléül a saját kormányaik által erre kellően feljogosított alulírott képviselők aláírták ezt a jegyzőkönyvet.

Kelt Genfben,..., angol és francia nyelven, mindkét szöveget, mely egyaránt hiteles, az Egyesült Nemzetek Oktatási, Tudományos és Kulturális Szervezete (UNESCO) irattárában helyezik letétbe, melynek főigazgatója eljuttat egy hitelesített másolatot minden aláíró és csatlakozó államnak."

4. § (1) Ez a törvény - a (2) bekezdésben meghatározott kivétellel - a kihirdetését követő napon lép hatályba.

(2) E törvény 2-3. §-a az Egyezmény 24. cikkében meghatározott időpontban lép hatályba.

(3)[2] Az Egyezmény, illetve e törvény 2-3. §-a hatálybalépésének naptári napját a külpolitikáért felelős miniszter annak ismertté válását követően a Magyar Közlönyben haladéktalanul közzétett egyedi határozatával állapítja meg.

(4)[3] E törvény végrehajtásához szükséges intézkedésekről a Nemzeti Kutatási, Fejlesztési és Innovációs Hivatal elnöke gondoskodik.
